On this part of the subject I beg to refer Your Lordship to Sir Arthur E. Kennedy who has, I think, considered it.

The draft of the new Ordinance will be transmitted shortly. It is not yet ready for transmission, but the list of crimes is the portion most difficult to settle. I am to place it in your Lordship's hands as early as possible, whilst there is a possibility of Sir Arthur E. Kennedy's being able to advise upon it.
